一、事实主要情况
   2008年7月28日早晨被告开着摩托车到浙北大厦上班,在地下车库前原告主动搭讪要求帮被告停放摩托车并拿走了被告手里的车钥匙,因被告急于上班所以没有拿回钥匙。过了四五十分钟浙北大厦购物中心保安室电话通知被告原告在停放摩托车过程中自己撞到车库的墙上,被告立即赶到事发地点时原告已被120送入湖州市中心医院,于是被告打110报案。经交警现场勘察作出交通事故认定:原告负事故全部责任。
   后来经爱山街道调解委员会对原被告进行调解,由于双方不能达成一致,于是原告于2009年6月30日向湖州市吴兴区人民法院提起诉讼。并出具了嘉兴新联司法鉴定所湖州分所出具的九级伤残鉴定书。
   诉讼请求:
   1、判令两被告共同赔偿原告医疗费25460.90元、护理费1273元、残疾赔偿金(九级)90908元、误工费23758元、住院伙食补助495元、营养费1000元、精神损失费10000元,共计人民币164352.9元。
   2、本案诉讼费由两被告共同承担。

  二、法院判决结果
   法院在审理过程中要求对原告的伤残进行重新鉴定,经杭州迪安医学检验中心司法鉴定所鉴定,认定原告为十级伤残。
   法院判决如下:

  湖州市吴兴区人民法院 民事判决书
   (2009)湖吴民初字第1168号

   经本院审查确认原告在本次意外事故中造成的损失为:医疗费35460.9元,护理费12730.98元(按照居民服务行业和其它服务行业2008年度全社会单位职工年平均工资211816元/年自2008年7月28日至2009年2月28日计算213天),伤残赔偿金45454元(按照2008年浙江省城镇居民人均可支配收入22727元/年计算20年的10%),鉴定费2200元,误工费15507元(按照2008年度浙江省全社会在岗职工年平均工资25918元/年自2008年7月28日至2009年2月28日计算213天
  ),住院伙食补助费990元(33天*30元/天),营养费1000元,合计113342.88元。
   1、被告应赔偿原告损失113342.88元的60%为68005.73元
   2、驳回原告的其余诉讼请求。


   三、被告对法院判决感到有失公平
   理由如下:
   1、判决书发出后,被告认为本案审判员施同生在判决所依据的证据材料上存在疑点。被告第一次要求查阅证据时审判员以种种理由不于查阅,第二次要求查阅时看到卷宗中原告提供的所有证据材料全部只有复印件。试问复印件能否作为定案依据??
   2、湖州市中心医院脑外科苏忠周医生按原告家属要求于
  2009年下半年补办休息证明两张号码为:0009522和0009523(内容均为:建议三个月休息门诊复查,每天需一人陪护),证明均未盖具医院公章。这两份证明能否作为有效的合法证据??法官是否有审查的义务??
   3、根据湖州市中心医院出具的原告出院记录,原告在住院期间(2008年7月28日至2008年8月30日共33天)没有进行手术治疗,出院时症状为:神志清、精神可,无恶心呕吐,无四肢抽搐,查体双瞳孔等大等圆,光反好,左肢体活动好,右上下肢活动差,1级肌力,右大腿内侧稍肿胀。好转。综上情况,是否需要6个月的休息和每天一人的陪护??法官是否有义务审查??
   4、原告为农村户口并长期居住于农村,判决书中却以城镇居民人均可支配收入22727元/年为标准来计算伤残赔偿金。是否合理??
   5、本案原告为自愿帮被告停放摩托车,在被告不在场的情况下撞到墙上,被告陈某某是否应承担60%的法律责任??
